Irene H. Chen, Esq.

Ms. Irene H. Chen represents and counsels foreign producers and U.S. importers in international trade matters. Prior to entering private practice, Ms. Irene H. Chen spent four years as an attorney in the Office of Chief Counsel for Trade Enforcement and Compliance at the U.S. Department of Commerce. Ms. Chen’s work at the Commerce Department included advising the Import Administration division on its antidumping and countervailing duty investigations and reviews and customs protests. Ms. Chen also represented the United States in international trade litigation matters, including cases at the U.S. Court of International Trade, the U.S. Court of Appeals for the Federal Circuit, and the World Trade Organization. While at Commerce, Ms. Chen served as a legal advisor to the Customs Liaison unit of the Import Administrative, rendering legal advice on matters pertaining to Customs import rulings.

Prior to her work at the Department of Commerce, Ms. Chen served as a staff attorney in the Office of the General Counsel at the U.S. International Trade Commission, where she advised the Commission on matters pertaining to injury determinations in antidumping and countervailing duty investigations. Ms. Chen has also worked at the law firms of Baker Donelson, LP, in Tennessee and Ding & Ding, in Taipei, Taiwan.

• Celik Halat Ve Sanayi v. United States (Ct. Int’l Trade Feb. 15, 2022) (Court No. 21-00045 and Court No. 21-00050), represented Turkish wire strand producer in judicial appeals of Department of Commerce’s AFA margins in antidumping/countervailing duty determinations, where the Court remanded determinations back to Commerce to calculate estimated AD/CVD margins for client.  In the AD proceeding, the margin was reduced from 158.22% to 2.06% and in the CVD proceeding, the margin was reduced from 53.65% to 17.88%.

• Qingdao Sea-Line International Trading Co., Ltd. v. United States (Court No. 19-00145) (appeal of final results of administrative review by the Department of Commerce)
• JSW Steel Ltd and JSW Steel Coated Products Ltd. v. United States (Ct. Int’l Trade May 9, 2018) (assisted client in winning a remand back to the Department of Commerce, where it reduced foreign producer’s countervailing duty rate from 29% to 4%)
• Assisted U.S. importer in obtaining a Section 301 Duties product exclusion from the U.S. Trade Representative, resulting in the expected refund of significant duties to client.
• Downhole Pipe & Equipment, L.P. v. U.S. International Trade Commission and United States (Fed. Cir. 2015)(assisted client in winning the revocation of antidumping and countervailing duty orders at the U.S. Trade Commission on drill pipe from the People’s Republic of China).
• Assisted U.S. importer in obtaining a “deemed liquidation” result from U.S. Customs and Border Protection, resulting in the client saving over $200k in antidumping duties.
